ProcessWurks, LLC. (“ProcessWurks”) is committed to protecting your privacy. We have prepared this Privacy Policy to communicate our practices regarding the Personal Data (as defined below) we collect from users of our website, located at www.ProcessWurks.com (“Site”), and Online Practice Management platform services (“Platform Services”) (collectively, the “ProcessWurks Services”). In connection with these Services, we may process personal information of individuals and our purpose for processing this information is to provide ProcessWurks Services. Your personal information is considered to be sensitive information that should remain confidential and protected from unauthorized collection, use, access, or disclosure. ProcessWurks management values the protection of all confidential and personal information within our organization; therefore, we have established privacy practices that facilitate the protection of your personal information.

Please read this Privacy Policy and our Terms of Service Agreement carefully before you start to use the Services. By using the Services or signing up for an account, you accept and agree to be bound and abide by the Agreement and consent to and agree that we may collect, process, use, retain, disclose, and transfer your Personal Data as described in this Privacy Policy. If you do not agree to the full Agreement, you must not access or use the Services.

We reserve the right to change this Privacy Policy at any time. We will alert you that changes have been made by indicating the “last updated” date of the current version. We encourage you to review this Privacy Policy from time to time to make sure that you understand how any Personal Data we collect will be used.

  1. Applicability and Eligibility

We need to process your Personal Data to operate our organization and provide you with our Services. By accepting the Agreement, you are confirming that you have read and understood these policies, including how and why we use your Personal Data. If you don’t want us to collect or process your Personal Data in the ways described in this Privacy Policy, you should not use the Services. Please note we are not responsible for the content or the privacy policies or practices of any third party organization or service that interact with our Services. We encourage you to read the privacy policies of these third-party organizations before using any of the Services.

    1. What types of information we collect from you depends on how you use the Services, what Services you use, and what information you choose to provide or make available to us. We collect information from you when you:

      • Create or register an account, and when you administer your account

      • Input information or data into any of our Services, or post or upload Content to our Services

      • Submit questions, requests, other communications to us via forms, email, or other communication media

      • Contact us for customer support or technical support

      • Visit any of our websites or portal

      • Participate in any promotions, demonstrations, contests, surveys, or other marketing events

      • Integrate third-party products and services with your ProcessWurks account

      • Client Information

      • Information related to the creation of accounts or that otherwise identifies you as a client/customer or end user of ProcessWurks is what we call “Client Information” Client Information may include certain “personally identifiable information” or “PII”, such as your name, email address, gender, postal address and phone number. It also may include payment information, such as payment method, credit card information, and any contact information (such as name and postal address) associated with payment billing information. If you are an end user using the Services through an account created on your behalf by a ProcessWurks Client (such as an employer, organization of which you are a member, or another individual), we may collect and process Client Information about you on behalf of the ProcessWurks Client with whom your use of the Services is associated.

    1. When you create an account with ProcessWurks, we may collect certain Client Information directly from you or, if you create your account using a third-party service (such as Google), we may collect Client Information about you from the third-party service (such as your username or user ID associated with that third-party service). By choosing to create an account using a third-party service, you authorize us to collect Client Information necessary to authenticate your account with the third-party service provider.

    1. Certain aspects of the Services allow you to link or integrate third-party products and services to enable certain features and functionalities with the Services. For example, you can connect your Facebook Campaign account or Ad Manager Account to /generate Content in ProcessWurks from information and data contained in your Meta Account. If you choose to use these features or functionalities, you may be asked to create an account with a third-party service provider or link your existing account with that service provider (and, by doing so, agree to the privacy policy and/or terms and conditions of that third-party). You may also be asked to authorize ProcessWurks to collect information from the third-party service provider on your behalf. We will then collect information (such as your username or user ID associated with that third-party service) from you and/or that third-party service provider as necessary to enable the Services to access your data and content stored with that third-party service provider. Once the authentication is complete, we have the ability to access information you provided to us or was otherwise collected by the third-party service in accordance with the privacy practices of that third-party service. We will store the information and data we collect and associate it with your ProcessWurks account, and we will only use that information and data to enable the integration of the Services with the third-party service provider and to perform actions requested or initiated by you, or that are reasonably necessary to carry out instructions provided by you.

3b. Content

One of the core aspects of the ProcessWurks Products (and our related Services) is that you can upload any information, data, content, material and anything that you need. We call anything you upload through the ProcessWurks Products “Content” You (and anyone who can interact with your use of the ProcessWurks Products) ultimately controls the nature of the Content, and our collection, use, and disclosure practices with respect to Content are separate from those with respect to other sorts of information we collect, including Client Information. As explained in detail above, we may also upload Content automatically with your authorization from third-party service providers (such as from your Facebook (Meta) Campaign or Ad Manager Page).

3c. Information Collected Via Technology

The following includes a description of information collected via technology associated with the ProcessWurks Services:

    1. Information Collected by Our Servers: To make our ProcessWurks Services more useful to you, our servers (which may be hosted by a third-party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

    1. Log Files: As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and click stream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our ProcessWurks Services to our users’ needs. Except as noted in this Privacy Policy, we do not link this automatically collected data to Personal Data.

    1. Cookies: Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use Cookies to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.     1. Analytics Services: We may perform analytics on the Platform Services or use third party analytics services, including but not limited to Google Analytics, on the Site or Application (collectively, “Analytics Services”), to help analyze how users use our ProcessWurks Services. We use the information we get from Analytics Services only to improve our ProcessWurks Services. The information generated by the Cookies or other technologies about your use of our ProcessWurks Services (the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on user activity. The Analytics Services may also transfer the Analytics Information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Service’s ability to use and share Analytics Information is restricted by such Analytics Service’s Terms of Service and Privacy Policy. By using our ProcessWurks Services, you consent to the processing of data about you by Analytics Services in the manner and for the purposes set out above.     1. Social Media platforms:

      1. We operate channels and pages on social media platforms. It is our process and protocol that any personally identifiable data gathered on these platforms is only in response to users interacting out of their own volition with our marketing pages.

      2. The contact is deemed as a legitimate business enquiry. The personal contact data is removed from the site once the enquiry is processed or the user has requested so.

    1. Information Collected from Third Party Companies: We may receive Personal Data from third party sources. We may add this information to the information we have already collected from you directly via the ProcessWurks Services.

  1. How we use the information we collect

We use the information we collect for a variety of purposes, and how we use it depends on what we collect (whether of a personal or technical information) and what Services you use (or features of the Services). These purposes may include:

    1. To carry out our obligations arising from any contracts entered into between you and us and provide you with Services.

    2. Responding to requests or inquiries from you

    3. Facilitate the creation of and secure your Account on our network;

    4. Identify you as a user in our system; provide improved administration of our ProcessWurks Services;

    5. Enable your use of the Platform Services and provide the Platform Services you request;

    6. Improve the quality of experience when you interact with our ProcessWurks Services;

    7. Send you administrative e-mail notifications, such as security or support and maintenance advisories;

    8. To send statements and invoices to you, and collect payments from you;

    9. Providing customer support or technical assistance

    10. Contacting you to provide product updates, information about products you have requested or purchased

    11. Marketing ProcessWurks products, services and features that you may be interested in, and monitoring the performance of our advertisements and marketing efforts

    12. Creating or administering your account, including identifying you with your account or the account of an ProcessWurks customer

    13. Deriving market insights, ways to improve the Services, and other business analysis or research purposes

    14. Customizing existing and future product offerings and other aspects of the Services to you and other users

    15. Securing the Services and our systems, and protecting your information and data.

    16. Sharing with third parties for the purposes discussed in “How we share information”, below.

    17. Any legitimate business purpose, provided that the information is aggregated and anonymised

    18. User Testimonials and Feedback: We often receive testimonials and comments from users/clients/customers who have had positive experiences with our Platform Services. We may post user feedback on the Site from time to time. We will share your feedback with your first name and last initial only. If we choose to post your first and last name along with your feedback, we will obtain your consent prior to posting you name with your feedback.

    19. Creation of Anonymous Data: We may create Anonymous Data records from Personal Data by excluding information (such as your name, email address, content of email) that makes the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of our ProcessWurks Services and improve Site navigation.

  1. Disclosure of Your Personal Data

We disclose your Personal Data as described below and as described elsewhere in this Privacy Policy.

    1. Third Parties integrated with application: When you use the ProcessWurks Services, the Personal Data you provide will be shared with the third parties that are currently integrated with our application – i.e. Outlook, Gmail, Facebook Ads, Google Ads, SendinBlue, Twilio, mailgun, Stripe.

    1. Users: We will share your Personal data with other users, your clients and business associates of the Platform Services that you designate and authorize solely for the purpose of providing you with the Platform Services.

    1. Processing of personal data by Third Party Service Providers: We may share your Personal Data with third party service providers to: a) provide you with the ProcessWurks Services; b) to conduct quality assurance testing; c) to facilitate creation of accounts; d) to provide technical support; and/or to provide other services to ProcessWurks. These third parties have only limited access to your information and may use your information only to perform these tasks on our behalf. Information we share with our Service Providers may include both information you provide to us and information we collect about you, including Personal Data and information from data collection tools like cookies, web beacons, and log files.

    1. Affiliates: We may share some or all of your Personal Data with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy.

    1. Other Disclosures: Regardless of any choices you make regarding your Personal Data (as described below), ProcessWurks may disclose Personal Data if it believes in good faith that such disclosure is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on ProcessWurks; (c) to protect or defend the rights or property of ProcessWurks or users of the ProcessWurks Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Service.

  1. Your Rights and Choices

    1. We seek to ensure all individuals are provided with the rights mandated by their governing jurisdiction. Not all of the rights discussed in this Privacy Policy will apply to each individual data subject and may not apply to you depending upon your jurisdiction.

    1. You may benefit from a number of rights in relation to the information that we process. Some rights apply only in certain limited cases, depending on your location. If you would like to manage, change, limit, or delete your personal data, you can do so by contacting us at privacy@ProcessWurks.com. Upon request, we will provide you with information about whether we hold any of your personal data. In certain cases where we process your information, you may also have a right to restrict or limit the ways in which we use your personal data. In certain circumstances, you also have the right to request the deletion of your personal data, and to obtain a copy of your personal data in an easily accessible format.

    1. To the extent that such rights are mandated by the laws applicable to the individual data subject based on their governing jurisdiction, the following rights may apply:

      1. the right to access (GDPR, Article 15);

      2. the right to rectification (GDPR, Article16);

      3. the right to erasure (GDPR, Article 17);

      4. the right to restrict processing (GDPR, Articles 18);

      5. the right of object (GDPR, Article 21);

      6. the right to data portability (GDPR, Article 20); or

      7. the right to lodge a complaint with an appropriate data privacy regulatory authority (GDPR, Article 77).

    1. Email Communications: We will periodically send you free newsletters and e-mails that directly promote the use of our Platform Services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly by email at unsubscribe@ProcessWurks.com. Despite your indicated e-mail preferences, we may send you service related communications, including notices of any updates to our Terms of Service or Privacy Policy.

    1. Client Data and Data Requests: Customers own all data they input into ProcessWurks. Customer data is retained for as long as they remain a ProcessWurks customer. If required, ProcessWurks will provide an export of the customer’s ProcessWurks data at no cost. The required format of the export will be discussed at the time of request. Direct access to the ProcessWurks databases is not available.

    1. Access to the information we have collected about you: We provide certain configuration and settings section within the Services to help you access, correct, delete, or modify your personal data associated with the Services. You may also contact us regarding the information we have collected about you, including regarding the nature and accuracy of the data that has been collected about you, to request an update, modification, or deletion of your information, to opt-out of certain Services uses of your information, or to withdraw any consent you may have granted to us. Please note that if you choose to delete your information or opt-out of the collection and use of your information, you understand that certain features, including but not limited to access to the Services, may no longer be available to you.

    1. Changing or Deleting Your Personal Data: You may change any of your Personal Data in your Account by editing your Account through the ProcessWurks Services or by contacting us directly using the contact information provided above. You may request deletion of your Personal Data by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may also retain your information for legal, fraud detection or similar purposes.

    1. Data Retention: We will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as an account is active or as needed to provide the Services to you. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. We also retain log files for internal analysis purposes. These log files are generally retained for a brief period of time, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for longer time periods. We may delete your personal data from our systems as part of a data retention plan. Following termination or deactivation of a Services Account, we may retain your information and content for a commercially reasonable time for backup, archival, and audit purposes.

    1. Where you have provided consent to certain data processing, you have the right to withdraw that consent at any time by contacting us at privacy@ProcessWurks.com. A withdrawal of consent will not affect the validity of our use of your personal data up until the point you have withdrawn your consent.

    1. If you no longer wish to use the Services or receive service-related messages (except for legally required notices), then you may contact us using the information above.

  1. How we secure your information

    1. The security of your personal data is important to us. We take reasonable efforts to secure and protect the privacy, accuracy, and reliability of your information and to protect it from loss, misuse, unauthorized access, disclosure, alteration, and destruction. We implement security measures as we deem appropriate and consistent with industry standards. As no data security protocol is impenetrable, we cannot guarantee the security of our systems or databases, nor can we guarantee that personal data we collect about you will not be breached, intercepted, destroyed, accessed, or otherwise disclosed without authorization. Accordingly, any information you transfer to or from Services is provided at your own risk.

Cloud security at ProcessWurks is the highest priority. As a ProcessWurks customer, you benefit from a data center and network architecture that are built to meet the requirements of the most security-sensitive organizations totally organized and managed by the Amazon Web Services(AWS).

      1. Security of Amazon EC2:

AWS responsibility “Security of the Cloud” – AWS is responsible for protecting the infrastructure that runs all of the services offered in the AWS Cloud. This infrastructure is composed of the hardware, software, networking, and facilities that run AWS Cloud services.

      1. Security of the cloud:

AWS is responsible for protecting the infrastructure that runs AWS services in the AWS Cloud. AWS also provides you with services that you can use securely. Third-party auditors regularly test and verify the effectiveness of our security as part of the AWS Compliance Programs

      1. Security Group:

In AWS, a security group acts as a virtual firewall that controls the traffic for one or more instances. We are using default security group as well custom security group policy to secure the services.

      1. Security, Identity, and Compliance:

ProcessWurks has implemented AWS Firewall Manager (Centralized security management). AWS Firewall manager is centrally configured and we manage the firewall rules across our accounts and the applications to secure your data.

    1. Passwords and Highly Confidential Data (HCD)

All passwords and highly confidential data are strongly, securely encrypted and stored via RDS services using the high level secured hash algorithms (256-bit encryption)

    1. Data Backups with high security.

AWS automated backup scheduler takes the backup on every day routine. The backup data are securely stored in the AWS cloud environment with protection layers. Similarly, during the essential period, the data restore process happens securely only through the AWS channel.

    1. Please do your part to help us keep your information secure. Services Account information is protected by a password. It is important that you protect against unauthorized access to your account and information by choosing your password carefully and by keeping your password and computer secure, such as by signing out after using the Services. You are responsible for maintaining the confidentiality of your password and Services Account and are fully responsible for all activities that occur under your password or Services Account. We specifically reserve the right to terminate your access to the Services and any contract you have with us related to the Services in the event it learns or suspects you have disclosed your Services Account or password information to an unauthorized third party.

    1. We make reasonable efforts to ensure that our other Service Providers have implemented physical, electronic, and procedural security measures to assist with safeguarding your personal data and to help protect against unauthorized access and disclosure. Only our authorized personnel and our Service Providers who perform legitimate business functions for ProcessWurks are authorized to access your personal data. Notwithstanding our efforts, the Internet has inherent security risks. ProcessWurks cannot promise, and you should not expect, that your personal data, personal searches, and other communications will always remain secure. You should take care with regard to how you handle and disclose your personal data or any username or password that you are required to use to access services on our websites and application.

  1. Data Integrity

ProcessWurks will only process personal data in a way that is compatible with and relevant for the purpose for which it was collected or authorized by you. To the extent necessary for those purposes, ProcessWurks will take reasonable steps to ensure that personal data is accurate, complete, current, and reliable for its intended use.

  1. Information and Data Transfers

    1. The Service is administered by ProcessWurks in the United States. When we obtain information about you through your access to or use of the Site or Service or when you input or import Data to the Service from somewhere other than the United States, we may transfer, process, and store such information and Data in the United States.

    1. If you access the Site and/or Service from outside the United States, you do so on your own initiative, at your sole risk, and you are responsible for compliance with all applicable laws.

If you are a non-United States resident and provide us with your personal information, or if you use the Service, you consent to the transfer to and processing of such information and any Data in the United States, which may have data protection laws less stringent than those in the country in which you reside.

    1. Additionally, if any Data or other information you provide to us includes the personal information of your clients, you confirm that you have all necessary authority and consents to transfer such data to us.

  1. Third Party Websites

    1. Our Site may contain links to third party websites. When you click on a link to any other website or location, you will leave our Site and go to another site, and another entity may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content.

    1. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of your Personal Data after you click on links to such outside websites. We encourage you to read the privacy policies of every website you visit. The links to third party websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content or websites.

  1. The Law Varies from Place to Place: The GDPR and CCPA

Privacy and data protection laws vary around the world and among the several United States. Most prominently, residents of California and data subjects whose personal information was obtained from them while they were in the European Economic Area, United Kingdom, and Switzerland, have certain additional rights in cases where the party collecting that information is governed by the applicable law. We have reviewed our business operations and data-related business practices with legal counsel in the context of the General Data Protection Regulation under European law (the “GDPR”) and the California Consumer Privacy Act (the “CCPA”). As a result of this review, as of the effective date of this Privacy Policy, we do not believe we are governed by either the GDPR or CCPA. We respect children’s privacy in particular. We do not target knowingly or intentionally collect personally identifiable information from children under the age of 13. If you become aware that your child has provided us with personal information without your consent, you are urged to email us at privacy@processwurks.com.

Any information that we collect is subject to the Privacy Policy in effect at the time such information is collected. We may, however, revise the Privacy Policy from time to time. If a revision is material, as determined solely by us, we will notify you, for example via email. The current version will always be posted to our Privacy Policy page. We may change this privacy policy at any time. If we make material changes to this privacy policy, we will prominently post that the policy has changed.

Please note that at all times you are responsible for updating your Personal Data to provide us with your most current e-mail address. In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. If you do not wish to permit changes in our use of your Personal Data, you must notify us prior to the effective date of the changes that you wish to deactivate your Account with us. Continued use of our ProcessWurks Services, following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
